Man registered domain well before Complainant existed.
A Hungarian company has been found to have tried reverse domain name hijacking presonate.com.
Presonate Zrt filed the dispute against a person in India who registered the domain in 2011.
The Complainant didn’t exist until 2019, so the case was dead on arrival.
Ankur Raheja of Cylaw Solutions, who represented the domain name owner, told Domain Name Wire that the initial complaint was only seven sentences long. In additional submissions, Presonate Zrt argued that while the domain was registered in good faith, it was subsequently renewed in bad faith.
Presonate initially tried to buy the domain before filing the UDRP.
Given the circumstances, World Intellectual Property Organization panelist Jeremy Speres had an easy decision, finding in the domain owner’s favor and finding that the case was reverse domain name hijacking.
