Court rules Scott Florcsk can intervene in lawsuit that didn’t name him but threatened his Handshake TLD .wallet.
A U.S. District Judge has ruled (pdf) that Scott Florcsk can intervene in a lawsuit Unstoppable Domains filed against Gateway Registry and James Stevens.
Unstoppable sued Gateway and Stevens after Gateway started offering second level domain registrations under .wallet, a blockchain-based top level domain based on the Handshake system. Unstoppable operates a rival .wallet extension on a different blockchain.
Florsck is the registrant of .wallet in Handshake and had contracted with Gateway Registry to offer the second level domains. The lawsuit didn’t name Florsck.
Neither Gateway nor Stevens showed up to defend the lawsuit. Florsck sought funding to fight the lawsuit, and Namecheap, which offers domains on the Handshake system, agreed to foot the bill. He then filed to intervene in the lawsuit even though he wasn’t named.
Unstoppable argued that Florsck shouldn’t be able to intervene. It said Florsk would not be implicated in the injunction Unstoppable sought “as long as he does not act “in concert with” Defendants.”
But the judge disagreed in a ruling issued Friday. He said that Unstoppable’s proposed order for default judgment and permanent injunctive relief stretches beyond just Gateway and Stevens and could impact Florsck.
Both Florsck and Unstoppable filed dueling lawsuits against each other after the initial lawsuit was filed.
