Facebook has won a judgment against a Montreal company in a San Diego court for spamming it’s members with emails that contained “false or misleading information” in the subject or header, violating the Controlling the Assault of Non-Solicited Pornography and Marketing Act.
According to Facebook, Adam Guerbuez, and his company Atlantis Blue Capital in Montreal, was able to acquire member passwords and sending them email messages about sex and drugs products.
The judgment for $873 million is the largest awarded under the 2003 Act, and eclipses the May 2008 ruling in favor of MySpace for $234 million when two men were accused of sending gambling and porn spam to it’s member base.
Max Kelly, Director of Security for Facebook says that he does not expect to ever collect the money awarded Facebook, but that the victory “represents a powerful deterrent”, and sends the statement that Facebook is “fighting hard” against spammers.
